IR35 Explained

  •  IR35, properly titled the “Intermediaries Legislation”, was introduced by the government in April 2000 as a measure to tackle ‘disguised employment’ - where employees were setting up Limited companies in order to reduce their tax bill, but continuing to work in the same role as when they were a permanent employee.
  •  IR35 applies to all contractors working through their own limited company. It was first implemented in the public sector (off-payroll rules) in April 2017 and was extended to the private sector in April 2021. 


What does this mean for contractors?

 Many contractors choose to operate their own Limited company to manage their contract income as it offers several tax benefits that result in more net income for them. However, the recent changes to IR35 legislation have imposed additional tax burdens on contractors who operate within these rules, which negates the tax advantages of having a Limited company. This includes the requirement to make a 'deemed salary' payment, which includes paying taxes, national insurance, and employer's national insurance to HMRC at the end of the year. In light of these changes, many contractors find it more beneficial to operate through an Umbrella company.
